effective as of August 1, 2017)
Article 1
These Measures are formulated in accordance with the Regulations on Pesticide Administration to regulate pesticide labels and instruction for use and ensure the safe use of pesticides.
Article 2
Pesticide products marketed and used within the territory of the People’s Republic of China shall bear labels printed on or affixed to the package. Where the product package is too small to include all content specified in these Measures on the label, an instruction leaflet shall be attached.
Article 3
The terms “labels” and “instruction leaflets” used in these Measures refer to all written, graphic or symbolic explanatory materials attached to or on pesticide packaging that provide information on the pesticide product.
Article 4
An applicant for pesticide registration shall submit a sample label and an electronic version when applying for pesticide registration. If an instruction leaflet is attached to the pesticide, a sample instruction leaflet and an electronic version shall also be submitted simultaneously.
Article 5
Pesticide labels and instruction leaflets shall be approved by the Ministry of Agriculture. When approving pesticide registration, the Ministry of Agriculture shall publish the content and the approved pesticide labels and instruction leaflets，as well as the approval date.
Article 6
The content of labels and instruction leaflets shall be truthful, standardized and accurate; the text, symbols and graphics shall be legible and easy to read, and shall not be altered or supplemented without authorization by pasting, cutting, altering or other means.
Article 7
Labels and instruction leaflets shall use standardized Chinese characters promulgated by the state and may be accompanied by Hanyu Pinyin or other languages. The meaning expressed in other languages shall be consistent with the Chinese text.
Chapter II Label Content
Article 8
A pesticide label shall indicate the following items:
(1) Pesticide name, formulation type, active ingredients and their content;
(2) Pesticide registration certificate number, product quality standard number and pesticide production license number;
(3) Pesticide category and color band, product performance, toxicity and its corresponding symbol;
(4) Scope of use, application method, application rate, technical requirements for sue and precautions;
(5) First aid measures for poisoning;
(6) Storage and transportation instructions;
(7) Production date, batch number, shelf life, net content;
(8) Name and contact information of the pesticide registration certificate holder;
(9) Traceable electronic information code;
(10) Pictograms;
(11) Other content required by the Ministry of Agriculture.
Article 9
In addition to the content specified in Article 8, the labels of the following pesticide products shall also comply with the corresponding requirements:
(1) Technical material (TC) or Technical concentrate (TK) products shall be marked with “This product is raw material for pesticide formulation processing and shall not be used on crops or in other places”, without application technical requirements and methods, except those approved for direct use by registration;
(2) Restricted-use pesticides shall be labeled with “Restricted Use” and specify special restrictions and requirements for use;
(3) Pesticides used on edible agricultural products shall indicate the safety interval, except for the circumstances listed in Paragraph 3 of Article 18;
(4) Rodenticide products shall display the prescribed rodenticide pictogram;
(5) Ready-to-use public-health pesticides may omit the distinctive color band;
(6) Labels of entrusted processed or repackaged pesticides shall additionally indicate the pesticide production license number, name and contact information of the entrustee, as well as the processing and repackaging dates;
(7) Pesticides exported to China may omit the pesticide production license number but shall indicate the overseas manufacturing site and the name and contact information of the office or agency established in China.
Article 10
If a pesticide label is too small to include all required content, it shall at least indicate the pesticide name, active ingredient content, formulation, pesticide registration certificate number, net content, production date and shelf life, together with an attached instruction leaflet covering all required content.
If the registered scope of use is too extensive to list in full on the label, part of the scope may be indicated as needed, provided the attached instruction leaflet includes the full scope of use.
Article 11
The pesticide name shall be identical to the name shown on the pesticide registration certificate.
Article 12
Contact information includes the domicile and production address, postal code, telephones number and fax number of the pesticide registration certificate holder, enterprise or institution.
Article 13
The production date shall be indicated in the order of year, month and day; the year shall be represented by four digits, and the month and day by two digits each. If the product batch number includes the production date, they may be shown together.
Article 14
The quality guarantee period shall specify the period during which product quality is guaranteed under normal conditions, and may also be expressed as the effective date or expiry date. may also be expressed as the effective date or expiry date.
Article 15
Net content shall be indicated in statutory units of measurement of the state. Special pesticide products may use appropriate formats according to their characteristics.
Article 16
Product performance mainly includes basic properties, main functions and characteristics. Descriptions of pesticide product performance shall be consistent with the scope and method of use approved at registration.
Article 17
Scope of use mainly covers applicable crops or sites and target pests.
Application method refers to the mode of application.
Application rate shall be expressed as the amount of formulated product used per mu or dilution rate. For seed treatment products, the application rate shall be expressed as the amount of formulated product used per 100 kg of seed. For special-purpose pesticides, application rate description shall be consistent with the content approved at registration.
Article 18
Application technical requirements mainly include application conditions, timing of application, number of applications and maximum number of applications, impacts on current and succeeding crops and preventive measures, crops allowed or prohibited for succeeding plantings, and interval periods.
Restricted-use pesticide labels shall indicate that warning signs shall be posted after application and specify the interval before humans and animals may re-enter.
The pre-harvest interval and the maximum number of application per crop cycle shall comply with actual agricultural production and pesticide use. The following pesticide labels may omit the pre-harvest interval:
(1) Pesticides for non‑edible crops;
(2) Seed treatment pesticides such as seed dressing, coating and soaking;
(3) Pesticides for non‑cultivated land (excluding pastures);
(4) Pesticides for pre‑emergence soil treatment ;
(5) Pesticides applied only once at the crop seedling stage;
(6) Rodenticides not applied by broadcast spreading;
(7) Public‑health pesticides;
(8) Other special circumstances.
Article 19
Toxicity is classified into five categories: extremely toxic, highly toxic, moderately toxic, low toxic and slightly toxic, marked respectively by the corresponding symbol and the Chinese characters for “extremely toxic”, “highly toxic”, “moderately toxic”, “low toxic” and “slightly toxic”. Symbols shall be black and characters red.
For formulated products processed from extremely toxic or highly toxic technical materials, if the toxicity category differs from the highest toxicity category of the technical materials used, the highest toxicity category of the technical materials shall also be indicated in parentheses.
Article 20
Precautions shall include the following:
(1) Main causes and prevention methods if the pesticide is likely to cause phytotoxicity or pest resistance;
(2) Clear explanation of potential adverse effects on humans, animals, surrounding crops, beneficial organisms (e.g., bees, birds, silkworms, earthworms, natural enemies, fish, daphnia and other aquatic organisms) and the environment, plus preventive measures and equipment cleaning requirements;
(3) Any known incompatibility with other pesticides;
(4) Correct opening method if opening the package may cause spillage or injury;
(5) Safety protection measures during application;
(6) Use scope or methods prohibited by state regulations.
Article 21
First aid measures for poisoning shall include poisoning symptoms and emergency/treatment measures for ingestion, inhalation, eye splashing and skin contact.
If a specific antidote exists, it shall be indicated together with medical advice.
Extremely toxic and highly toxic pesticides shall display a poisoning emergency hotline.
Article 22
Storage and transportation instructions shall include environmental conditions (light, temperature, humidity, ventilation) and handling precautions, plus warnings such as “Keep out of reach of children” and “Do not store with food, beverages, grain, feed, etc.”
Article 23
Pesticide categories shall be indicated by corresponding characters and distinctive color bands.
Different pesticide categories shall be marked with a fadeless color band parallel to the bottom edge at the bottom of the label.
Herbicides shall be indicated by the characters "Herbicide" and a green band; insecticide (acaricide, molluscicide) shall be indicated by the characters "Insecticide", "Acaricide" or "Molluscicide" and a red band; fungicide (nematicide) shall be indicated by the characters "Fungicide" or "Nematicide" and a black band; plant growth regulator shall be indicated by the characters "Plant Growth Regulator" and a dark yellow band; rodenticide shall be indicated by the characters "Rodenticide" and a blue band; insecticide/fungicide shall be indicated by the characters "Insecticide/Fungicide" and red and black bands. The descriptive characters of the pesticide category shall be embedded on the color band in a contrasting color. Other pesticides may omit the distinctive color band.
Article 24
The traceable electronic information code shall be displayed as a QR code or equivalent, which can be scanned to identify information such as the pesticide name and the name of the registration holder. It shall not contain text, symbols or graphics that violate these Measures.
The format and generation requirements of the traceable electronic information code shall be separately formulated by the Ministry of Agriculture.
Article 25
Pictograms include storage, operation, advice and warning pictograms. They shall be selected based on safe use needs and arranged according to actual operation sequence, but shall not replace necessary text instructions on the label.
Article 26
Labels and instruction leaflets shall not contain promotional or advertising text, symbols, graphics, enterprise awards or honorary titles, unless otherwise provided by laws, regulations or rules.
Chapter III Production, Use and Administration
Article 27
Each smallest unit of pesticide package shall have an independent label printed or affixed; sharing labels with other pesticides is prohibited.
Article 28
The height of Chinese characters on the label shall be no less than 1.8 mm.
Article 29
The pesticide name shall be prominent and conspicuous, with uniform font, size and color, and comply with the following requirements:
(1) For horizontal labels: it shall be prominently displayed in the middle of the upper one‑third area of the label; for vertical labels: it shall be prominently displayed in the middle of the right one‑third area of the label;
(2) Do not use hard-to-read fonts such as cursive or seal script, and do not modify the font using italics, hollow text, shadows, or other forms;
(3) Font color shall form a strong contrast with the background color ;
(4) Except where the size of the package precludes writing on the same line, no line breaks are allowed.
Except for the words “Restricted Use”, the font size of other text content on the label shall not exceed that of the pesticide name.
Article 30
Active ingredient(s), content (s)and formulation type shall be prominently indicated directly below (horizontal label) or to the immediate left (vertical label) of the pesticide name (ready‑to‑use public‑health pesticides may omit the formulation). Character height shall be no less than half that of the pesticide name.
Formulations containing more than one active substance shall indicate the total active ingredient content and the Chinese common name and content of each active ingredient, prominently displayed directly below (horizontal) or left (vertical) of the pesticide name, with uniform font, size and color, and character height no less than half that of the pesticide name.
Article 31
Unregistered trademarks are prohibited on pesticide labels and instruction leaflets.
Registered trademarks, if used, shall be placed in one of the four corners of the label, occupying no more than 1/9 of the label area, and their text shall not exceed the font size of the pesticide name.
Article 32
Toxicity and its corresponding symbol shall be indicated directly below (horizontal) or to the immediate left (vertical) of active ingredient content and formulation, with strong contrast against the background.
Pictograms shall be printed in black and white, generally at the bottom of the label, with size proportional to the label.
Safety interval and number of applications shall be prominently displayed in a font larger than other application technical text.
Article 33
“Restricted Use” shall be printed in red at the top‑right or top‑left corner of the label front, with strong background contrast, and its font size shall be no smaller than that of the pesticide name.
Article 34
Labels shall not contain false or misleading content. Any of the following constitutes false or misleading content:
(1) Misleading users to expand use scope, increase application rate or change application methods;
(2) Text, symbols or graphics on public‑health pesticide indicating that the product is suitable for children, pregnant women, allergic persons or other vulnerable groups;
(3) Exaggerating performance, false advertising, denigration or comparison with other products likely to cause confusion;
(4) Use of any organization or individual’s name or image for endorsement;
(5) Absolute claims such as guaranteed high yield, yield increase, elimination, eradication, or quick effect;
(6) Promises of insurance or “ineffective refund”;
(7) Other false or misleading content.
Article 35
Labels and instruction leaflets shall not display any scope of use or application method not registered and approved.
Article 36
Except for the required name and contact information of the registration holder, enterprise or institution, no other enterprise or institution’s name or contact information shall appear on the label.
Article 37
Product toxicity, precautions, technical requirements and other safety‑ and efficacy‑related content shall not be altered without approval once approved. Certificate or License numbers, production dates, enterprise contact information and other other product-identifying or enterprise-related information shall be labeled by the enterprise, which shall be responsible for their authenticity.
Article 38
If a pesticide registration certificate holder intends to change safety‑ or efficacy‑related content on the label or instruction leaflet, it shall apply to the Ministry of Agriculture for re‑examination and approval.
The Ministry of Agriculture shall issue a decision within three months.
Article 39
Based on monitoring and evalsuation results, the Ministry of Agriculture may require the registration holder to revise labels and instruction leaflets and submit them for re‑approval.
If any item on the pesticide registration certificate is changed, the Ministry of Agriculture shall re‑approve the label at the same time as approving the registration change.
Article 40
Three months after re‑approval of labels and instruction leaflets, the original versions shall no longer be used.
Article 41
Violations of these Measures shall be penalized in accordance with relevant provisions of the Regulations on Pesticide Administration.
Chapter IV Supplementary Provisions
Article 42
These Measures shall come into force on August 1, 2017. The Measures for Administration of Pesticide Labels and Instructions for Use promulgated by the Ministry of Agriculture on December 8, 2007 shall be repealed simultaneously.
Existing labels or instruction leaflets inconsistent with these Measures shall be replaced by compliant versions starting January 1, 2018.
